Omg. Teen who 'shot mother dead because he was tired of her name calling' is tried as an adult
A 14-year-old boy will stand trial as an adult in the shooting death of his 36-year-old mother, which he allegedly did because he was tired of her constant put downs.
A 36th District Court judge determined on Thursday that there was enough evidence to send Detroit boy Joshua Smith's case to Wayne County Circuit Court.
Smith faces an adult charge of first-degree murder and using a firearm during a felony. Arraignment is set for March 15.
Police say Tamiko Robinson was shot to death on February 27 at her home following an argument with the teenager.
A shotgun belonging to the boy's stepfather was used in the shooting.
An officer said Smith told investigators he was tired of being called names
The judge denied a request by defense lawyer George Chedraue to have his statements to police suppressed because of his age.
In one of the statements which was read out in court yesterday, he said as he was walking down the stairs with the gun he was thinking, 'I am tired of this'. He also told police it wasn't his intention to kill her even though he allegedly shot her ten times
According to Smith's statement, his mother sent him to get medicine she takes for kidney failure, when he ignored her she said: 'You ain't going to be nothing', before telling him he had to sleep on the floor.
His mother's fiance Chika Lewis was upstairs sleeping with his five-year-old daughter.
He woke when smith fired the first shot, the court heard.
Lewis testified: 'I heard my fiancée scream out, "Joshua, no!" And then I heard her scream out for me, too.'
Six more shots rang out, he said.
Lewis, holding his daughter in his arms, went in to the room and saw Smith pointing the shotgun at him, he told the court.
In his statement, Smith said he didn't shoot Lewis because he was holding his sister.
